Old family estate could be hard to untangle. However, the faster you deal with it the faster it will be solved. Some cases involve some investigation, e.g. going to the Land Office, searching for old Court Files, Bank, Unclaimed Money Department etc. which requires a lot of running around.
We will explain the proceedings in Malaysia and how the law applies to your case. We will also explain how you can best process the estate so that you don’t have to pay more that you need too.
Example
One of the usual cases we encounter is the Deceased’s Property has a Bank charge on the property although the Deceased has fully paid up the Bank about 10 years ago (evidence by the family has the Original Land Title with them). The Bank had been taken over by another Bank. The Beneficiaries of the estate now wants to sell the Property.
We have managed to remove the Charge in the Land Title, and later managed to complete the Sale and Purchase of the Property to a new Purchase and the Beneficiaries of the estate could unlock the Deceased’s Property.
In another example, in one case, the Administrator of the Estate has not been doing anything on the estate for the pass 30 years. We have managed to remove the Administrator of the Estate (via a Court Order) and appointed another Beneficiary of the Estate to be the Administrator. As such the new Administrator could sell/transfer the Deceased’s estate.
